Terms of Service

Welcome to SQF Consulting. These Terms of Service govern your access to and use of our food safety consulting services, website, and related services. By registering an account, accessing our platform, or using any of our services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you (either individually or on behalf of the entity you represent) and SQF Consulting. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. We may update or modify these Terms from time to time, and your continued use of the platform after any changes indicates your acceptance of the revised Terms.

To access certain features of our software or consulting portal, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify SQF Consulting of any unauthorized use of your account or any other breach of security.

Subject to your compliance with these Terms, SQF Consulting grants you a limited, non-exclusive, non-transferable, revocable license to access and use our software and consulting portal during your subscription term. You agree not to copy, modify, distribute, sell, or lease any part of our software, or reverse engineer or attempt to extract the source code of our platform, unless applicable laws prohibit these restrictions or you have our written permission.

You retain all rights, title, and interest in and to the data, files, and information that you upload or process within the SQF Consulting platform. You grant SQF Consulting a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your customer data solely for the purpose of providing and improving our services. You represent and warrant that you have all necessary rights and permissions to upload and process your data on our platform.

You agree not to use the SQF Consulting platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our servers or networks. Prohibited activities include attempting to gain unauthorized access to any part of the platform, uploading malicious code or viruses, scraping or harvesting data without authorization, or using the platform to violate the intellectual property or privacy rights of others.

SQF Consulting subscription fees are billed in advance on a monthly or annual basis, as specified in your order form. All fees are non-refundable except as expressly provided in these Terms or required by law. You are responsible for paying all applicable taxes associated with your use of our services. Failure to pay fees when due may result in the suspension or termination of your access to the platform.

Either party may terminate this agreement or any subscription order form for convenience upon 30 days' written notice, or immediately if the other party materially breaches these Terms and fails to cure the breach within 15 days of receiving written notice. Upon termination, your right to access the platform will immediately cease, and SQF Consulting will delete or return your customer data in accordance with our data retention policies and applicable laws.

To the maximum extent permitted by law, SQF Consulting and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the platform. In no event will our total liability for all claims exceed the amount paid by you to SQF Consulting in the twelve months preceding the event giving rise to liability.
